Chapter 10: Licenses & Permits (Ebensburg, PA)
This chapter outlines the regulations for various permits and licenses required to operate specific types of businesses or events within the Borough of Ebensburg.
Part 1: Garage and Yard Sale Permit
- Purpose: To control and restrict casual sales to protect public health, safety, and neighborhood character.
- Frequency & Duration: A maximum of two (2) sales per household per calendar year, lasting no more than two (2) consecutive days.
- Hours: Sales are permitted from 7:00 a. m. until sunset.
- Signage:
- One (1) sign up to 4 square feet on the property.
- Two (2) directional signs, each up to 2 square feet (not on a major thoroughfare).
- Signs must be removed by the conclusion of the sale.
- Penalties: A fine of up to $600 and/or imprisonment for up to 30 days.
Part 2: Sexually Oriented Business Operations
- Purpose: To regulate the location and concentration of these businesses to promote public welfare.
- Prohibited Locations: These businesses are not permitted within the Borough of Ebensburg, with some exceptions for certain zoning districts in Cambria and Jackson Townships.
- Classified Businesses: Includes adult arcades, bookstores/video stores, cabarets, motels, motion picture theaters, theaters, escort agencies, nude model studios, and sexual encounter centers.
- Exemptions: Modeling classes operated by accredited schools or universities are exempt under specific conditions (e. g. , no exterior advertising, student enrollment 3 days in advance).
- Injunctions: Violators are subject to legal action for injunctions.
Part 3: Transient Retail Business
- Definition: Engaging in peddling, soliciting, or taking orders for goods on public streets, from house to house, or at temporary fixed locations.
- License Required: A valid license is required to operate. Applications must be made in person to the Police Chief.
- Application Requirements: Applicants must provide personal information (name, address, Social Security number), details about their employer/principal, the types of goods sold, and a criminal record request form.
- License Conditions: The license card must be carried at all times, is non-transferable, and the holder cannot enter a dwelling without invitation.
- Exemptions: Includes persons soliciting for registered nonprofits, licensed real estate/insurance brokers, and farmers selling their own produce.
- Penalties: A fine of up to $600 and/or imprisonment for up to 30 days.
Part 4: Junkyards
- Permit Required: An annual permit from the Zoning Officer is required to operate a junkyard.
- Location Requirements: The junkyard must be at least 100 feet from any residence.
- Operational Rules:
- Must be enclosed by a continuous fence at least 6 feet high.
- Loading/unloading and use of breakup hammers are restricted to 7:00 a. m. - 6:00 p. m.
- Must be kept clean and sanitary.
- The owner must maintain an up-to-date list of all junk acquisitions for at least one year.
- Appeals: Decisions by the Zoning Officer can be appealed to the Zoning Hearing Board within 30 days.
- Penalties: A fine of up to $6,000 and/or imprisonment for up to 30 days.
Part 5: Special Events and Parades
- Permit Required: A special event permit from the Borough Manager is required for any parade or public gathering on public property.
- Application Deadline: Applications must be filed at least 28 days in advance of the event.
- Application Requirements: Must include details such as the organizer's information, event date/time/route, expected number of participants/vehicles, and a map of the course.
- Fees & Costs: The applicant is responsible for all direct costs incurred by the Borough, including police and public works services. If these costs exceed $300, the applicant is billed for the difference.
- Insurance: Applicants must provide a certificate of insurance with liability coverage of at least $1,000,000. The Borough must be named as an additional insured.
- Permit Denial/Revocation: Permits can be denied or revoked for reasons including incomplete applications, material falsehoods, safety concerns, or conflicts with other events.
- Appeals: Denied permits can be appealed to the Borough Council within 10 days.
- Penalties: A fine of up to $600 and/or imprisonment for up to 30 days.
