Chapter 9: Housing — Landlord Reports (Part 1)

This ordinance, enacted by the Borough of Ebensburg on March 26, 2007 (Ordinance No. 546), establishes reporting requirements for landlords to ensure fair tax distribution and promote public health, safety, and welfare.

Key Definitions

  • Business Unit: Real estate used for commercial activity.
  • Dwelling Unit: One or more rooms arranged for living/sleeping by one family or person(s).
  • Landlord: Owner or agent of real estate/buildings in Ebensburg.
  • Person: Individual, partnership, association, firm, or corporation.
  • Tenant: Person using a dwelling or business unit owned by someone else for over 30 days — even if no rent is paid.

Reporting Requirements

Initial Report (§9-103)

Within 30 days of the ordinance’s effective date, every landlord must submit a printed report to the Borough Office including:

  • List of all dwelling and business units owned in Ebensburg (occupied or not)
  • Address of each unit
  • Whether any unit is inhabited/utilized by tenants
  • Names of all tenants aged 18 or older using those units

New Landlords (§9-104)

Anyone who becomes a landlord after the effective date (via sale, deed, or other means) must file the same report within 30 days of acquiring ownership.

Changes in Use or Occupancy (§9-105)

Landlords must report any change in use or occupancy (e. g. , new tenant, vacancy) in writing to the Borough Office within 10 days of becoming aware. Reports must include:

  • Name(s) of new tenant(s)
  • Date change occurred
  • Forwarding address of previous tenant(s), if known

Note: Filing these reports does not relieve the landlord of responsibility for unpaid fees or utilities incurred by prior tenants.

Penalties (§9-106)

Violating any provision of this part results in:

  • A fine of up to $600, and/or
  • Up to 30 days imprisonment if the fine is not paid

All provisions were enacted under Ordinance 546, effective March 26, 2007.
